Terms of Service Agreement

Welcome to join Pkulaw.com! Before you register to use products and services provided by Beijing Chinalawinfo Co., Ltd. (hereinafter referred to as “Pkulaw.com”), please read, understand and agree to this Agreement, especially those bold terms.

When you register for Pkulaw.com, by checking “I have read and agreed to Terms of Service and Privacy Policy”, you acknowledge that you have read, understood, and agreed to be bound by all terms of this Agreement, as well as Privacy Policy, legal notices, and other guiding rules contained herein.

Pkulaw.com reserves the right, at its discretion, to modify the terms of this Agreement as necessary without prior notice. Please check this Agreement periodically for changes. Your continued use of our products and services following the posting of changes to these terms indicates that you agree to follow and be bound by these terms.

1.User Registration and Information Protection

1.1 To register for Pkulaw.com, you are required to enter basic information, which you hereby agree to keep true, accurate, and updated. If the basic information you provide is false, inaccurate, or outdated, in no event shall Pkulaw.com be liable for any damage caused by such information, and we have the right to suspend or terminate your access.

1.2 You may choose to provide more personal information as prompted during the registration process. Pkulaw.com may provide you with more personalized services based on your profile.

1.3 If you register for Pkulaw.com on behalf of such a legal entity as a legal person or an unincorporated organization, the entity you represent will be deemed to have agreed to be bound by the terms of this Agreement.

1.4 After completing the registration process, you will get a username and password for your Pkulaw.com account. Usually, the username is your phone number or email address. You may change your password under instructions. You will be responsible for the confidentiality of your username and password, as well as all activities and events that occur in connection with your account. Without the written consent of Pkulaw.com, you may not share or disclose your account to any third party by providing your username or password, or other method of using your account. You agree to immediately notify us if you find that your account is lost, leaked, or stolen, or if there is any unauthorized use of your account, or any other breach of security.

1.5 Pkulaw.com is well aware of the importance of personal information to you. We will collect, store, and use your personal information in strict accordance with the relevant legal requirements and our publicly available Privacy Policy, and take corresponding measures to protect your personal information and privacy rights and interests.

2. Service Type and Service Content

2.1 After you have successfully registered for a Pkulaw.com product, you will enjoy certain access to its basic functions and content as a registered user. The Pkulaw.com reserves the right, in its sole discretion, to decide the basic functions and content of the product provided for registered users as actually needed, and to change, suspend or terminate your access to the product (or any portion thereof) at any time.

2.2 If you participate in a free trial offer for a Pkulaw.com product under certain conditions and procedures, you will get access to its corresponding business functions and services within the trial scope during the trial period.

2.3 If you become a premium member of a Pkulaw.com product by entering into a contract in the form of a written contract, an order, a letter, or data message, among others, you will get access to its corresponding business functions and services as agreed upon in the contact within the contract term.

3. User Rights and Obligations

3.1 You have the right to access, inquire about, search, download, print, refer to, or quote the content of the Pkulaw.com product according to your user type and access permissions, but your authorized access is limited to the written contract, service agreement, or other written agreements made between you and Pkulaw.com, and only for legitimate and reasonable private purposes according to the nature and purpose of the contract and usage of trade under the principle of good faith. Without the written permission of Pkulaw.com, you may not use our product beyond the agreed purposes or methods. Otherwise, we may seek legal action against you.

3.2 Without the written consent of Pkulaw.com, you may not engage in illegal use conduct, including but not limited to:

(a) Illegally using or allowing any third party to illegally use the Pkulaw.com product by copy, transfer, offer, selling, release, dissemination, display, data mirror, uploading, downloading, linking, or any other means beyond the agreed access permissions and legitimate and reasonable private purposes;

(b) Maliciously influencing the normal product functions and services of Pkulaw.com in any unconventional way;

(c) Maliciously registering for, publishing, transmitting, misappropriating, or selling the Pkulaw.com products, accounts, content, or services in any way for seeking illegal gains;

(d) Accessing, attempting to obtain, obtaining, copying or monitoring any content of Pkulaw.com by using any automatic or manual process, device, program, algorithm, or any other method (such as crawlers, browser plug-ins and add-ons, or other technology) that is not provided by Pkulaw.com; and

(e) Illegally hacking into, interfering with, and damaging the computer systems or other internal information and network systems of the Pkulaw.com.

3.3 You may not engage in illegal conduct by way of access to and use of the products and services of Pkulaw.com, including but not limited to:

(a) Transmitting or publishing illegal information, including information in violation of the Constitution and the Law, information that contravenes such national policies as ethnic and religious policies, information on feudal superstition, information that infringes upon any other person’s lawful rights and interests, and other information contrary to public order and good morals;

(b) Endangering national security;

(c) Endangering the network operation security and information security;

(d) Endangering data security; and

(e) Violating the Personal Information Protection Law.

3.4 You may not denigrate or degrade the reputation of Pkulaw.com.

3.5 If we find any aforesaid illegal conduct, Pkulaw.com has the right to suspend or terminate your access to our products and services, and you will be held legally liable. If damage is caused to others due to your illegal conduct, you shall bear the corresponding legal responsibility.

4. Pkulaw.com Rights and Obligations

4.1 Pkulaw.com shall provide you with corresponding products and services in accordance with relevant contracts and this Agreement, and have the right to ask you to fulfill relevant payment obligations as agreed.

4.2 All software or content copyrights involved for the Pkulaw.com products and services shall belong to Pkulaw.com or the third parties that grant the copyright license thereto (hereinafter referred as “licensors”), which is protected by the Copyright Law of the People’s Republic of China and other relevant laws and regulations, as well as the relevant international treaties. You shall access or use the Pkulaw.com products and services for private purposes in a legitimate and reasonable manner pursuant to the written contract, service agreement and other written agreements reached between our two parties, in compliance with the nature and purpose of the contract and usage of trade, and under the principle of good faith. Without the written permission of Pkulaw.com, no user may access and use our products and services including the website, software, content, or any portion thereof in the form of bulk data crawling, copying, mirroring, or downloading, among others, beyond the legitimate and reasonable scope for private purposes, provide them to any third party by data crawling, copying, transferring, selling, publication, or any other means, and provide tables of contents, databases, special topic columns or other derivative works to any third party by directly or indirectly plagiarizing, extracting, analyzing, adapting, compiling the data content of our products and services. In such cases, Pkulaw.com reserves the right to suspend or terminate your access to our products and services and seek legal action against you according to the law.

4.3 All trademarks, names, logos, signs, service marks, etc. involved for the Pkulaw.com products and services shall belong to Pkulaw.com, which are protected by the Trademark Law of the People’s Republic of China, and other relevant laws and regulations, as well as the relevant international treaties. Without the written authorization of Pkulaw.com, no one may use, replicate or imitate them, otherwise whoever is involved will be held liable as legally required.

4.4 All patents or other relevant technological achievements and technical information involved for the Pkulaw.com products and services shall belong to Pkulaw.com, which are protected by the Patent Law of the People’s Republic of China, and other relevant laws and regulations, as well as the relevant international treaties. If anyone infringes on our aforesaid rights and interests, Pkulaw.com reserves the right to hold the relevant person liable according to the law.

4.5 The ownership of all source codes, binary-coded software, code examples, application program interfaces (“APIs”), software development kits (“SDKs”), relevant document and other materials involved for the Pkulaw.com products and services shall belong to Pkulaw.com or its relevant licensors. Without the written permission of Pkulaw.com, anyone may not in any way conduct reverse engineering, decompilation, decomposition, disassembly, adaptation, implanting or any other derivative operations on our products and services, nor in any way study the product internal realization, obtain the product source codes, steal corresponding intellectual property achievements, or disclose any result of performance tests. Pkulaw.com reserves the right to hold the relevant person liable according to the law.

4.6 Without the written authorization of Pkulaw.com, anyone may not in any way reveal to a third party any technical information, business operation information, customer information, or relevant trade secrets that you have acquired from Pkulaw.com but is not publicly available. Pkulaw.com reserves the right to hold the relevant person liable according to the law.

5. Liability for Breach of Contract and Disclaimer of Warranties

5.1 If there is an express agreement on liability for breach of contract in the relevant contract and this Agreement, the defaulting party shall assume the liability for breach of contract as stipulated therein. In the absence of such an agreement, either party may hold the defaulting party liable according to the law.

5.2 The Pkulaw.com products and services mainly arise from the development and utilization of such data as laws and regulations published by the state, guiding cases from the Supreme People’s Court (“SPC”) and the Supreme People's Procuratorate (“SPP”), cases from the SPC Gazettes and the SPP Gazettes, model cases published by the people’s courts of all levels, adjudicative documents available on the Internet, judicial documents published by people's procuratorates, administrative penalty decisions published by administrative agencies, Party regulations published in the form of documents on the Party’s media, and relevant legal news published by Internet news source entities, by relying on the Internet, big data, artificial intelligence and other technologies. Please note that when citing the specific content of such data, you shall check it with the standard or official text in a prudent manner, and solely assume the corresponding legal consequences and liability.

5.3 The Pkulaw.com products and services may contain such third party content obtained by means of the copyright licensing as journal articles, law firm publications, expert interpretations and videos, as well as such user generated content as contributed articles and comments. Pkulaw.com neither endorses nor makes any representation or warranty whatsoever regarding the said content or any opinion or position expressed therein. In the event of any dispute arising therefrom, the relevant content publisher shall assume the corresponding legal liability.

5.4 The Pkulaw.com products and services may contain such applications as legal mind maps, knowledge graphs, intelligent discovery, and intelligent Q&A, which are developed on the basis of relevant laws and regulations, cases, opinions already published by experts, and content further processed by our editing teams, among others, by relying on the Internet, big data, artificial intelligence, and other technologies. The information contained therein does not constitute any professional legal advice, but serves as supporting reference materials for users to study, judge, and solve relevant problems. The users who act on the said information will do so entirely at their own risk, while Pkulaw.com is under no obligation to, and does not be liable for any direct or indirect losses caused by their use of or reference to relevant content.

5.5 The Pkulaw.com products and services may invoke, use, or link the interface and data from third party websites and software systems such as TianYanCha.com and Lawbank.com.tw. The third parties shall be directly responsible for legality, legitimacy, completeness, timeliness, accuracy and continuity of their data, content or services, as well as the corresponding rights ownership, protection and other issues. Pkulaw.com shall not be liable for any direct or indirect losses caused by invoking or using the data, content or services of the third parties.

5.6 In the course of your use of the Pkulaw.com products and services, Pkulaw.com shall not assume any legal responsibility for any influence on or losses to computer systems as a consequence of computer viruses, or other malicious software, applications, and codes, unless the losses are caused due to intention or negligence of Pkulaw.com.

5.7 You hereby agree that the Pkulaw.com services are provided on an “as is” and “ as available” basis. During your access to and use of our products and services, in the event of any speed drop resulting from the blocked Internet access, any temporary service interruption arising out of our server configuration or maintenance, or any damage to or loss of data, or service interruption caused by any unforeseeable technical problems or other factors, the foregoing circumstances shall not be deemed breach of contract and Pkulaw.com do not assume any liability therefor.

5.8 In the event of the certain data service being suspended or terminated due to the law and policy adjustment of the state, Pkulaw.com shall not assume any legal liability therefor, and as actually needed have the right to ask you to withdraw, conceal, delete, or no longer use the relevant data that you have stored, downloaded, or linked to your private Internet systems and networks in due time.

6. Governing Law and Dispute Resolution

6.1 This Agreement shall be governed by the laws of the People’s Republic of China.

6.2 Any dispute over the signing or performance of this Agreement shall be settled through negotiation. If the negotiation fails, either party may bring an action in the people’s court having jurisdiction in the Chinese Mainland.

7. Miscellaneous

7.1 Except as otherwise expressly stated by Pkulaw.com, any new content and functions along with the scope expansion or function enhancement of our products and services shall be subject to this Agreement.

7.2 The Privacy Policy and legal notices published on relevant product pages are integral parts of this Agreement.

7.3 In the event of any discrepancy between the terms in the written contract signed or the order placed and this Agreement in your purchase of the Pkulaw.com products and services, the written contract or order shall prevail.
